Overtime Exemption: Computer Software Employees

Beginning January 1, 2013, the minimum wage criterion for determining computer software employees’ exemption status is increased as follows:

These adjustments were based on a 2.6% increase in the California Consumer Price Index for Urban Wage Earners and Clerical Workers, issued by memorandum of the California Department of Industrial Relations.

Remember that salary is not the only criterion for establishing exemption status for computer professionals.  Check with your organization’s labor attorney to confirm all functional requirements are met before classifying any position as exempt.
